Gas-Fired

The Owner of
a gas-fired power plant executed an EPC agreement to integrate two
gray-market HRSGs and one gray-market STG with the existing
plant. The EPC had difficulty with the HRSGs, STG, design,
productivity, and quality. The EPC filed an Arbitration demand to
resolve outstanding Proposed Change Orders (PCOs), and the Owner
counterclaimed for defect corrective costs. An Expert Report was
developed which analyzed entitlement, schedule and damages.
Expert Testimony was provided at the Arbitration.

Waste-Fired

The cause of
alleged design-related cost overruns was evaluated to defend the A/E
for its work on an 18mW refuse-burning power plant which required a
peer-review of the design. It was determined that the
code-required peer design review caused the additional costs due to
unreasonable demands for 'proof' of the quality of process, piping, and
structural design. An Expert Report was prepared allowing a
successful negotiation between the A/E and the Owner.

Coal-Fired

The EPCM had
a lump-sum contract to design and build this 3,200 MW coal-fired power
plant. Services included risk management, planning &
scheduling, estimating, cost control, and certain contract development
across all phases of the project (design, procurement, construction and
start-up). Duties also included pre-qualifying bidders and the
development of fair-value estimates to evaluate bids. All
estimates (project-wide as well as fair-value) were analyzed with the
Monte-Carlo approach to evaluate project cost risk. The project
completed ahead of schedule and under budget.
