Offshore Exploration (Semi-Submersible Drill Rig)

The
Owner of a semi-submersible drill rig hired a JV to modify the rig to
make it capable of processing approximately 40,000 bbl of oil and 100
MMcf of gas daily. The Owner was defended against a claim by the
JV. An Expert Report was developed which analyzed the JV's claim,
schedules, budgets, change orders, and actual costs. This
included an evaluation of the JV's alleged damages and payments.
Through participation in several negotiations, and Expert Testimony at
mediation, the dispute was settled.

Mining & Metals

The
GC was defended against claims by the design-builder (EPC) related to
three contracts held by the GC for the construction of a phosphate
processing plant. This included an evaluation of a) status at
notice to cure and at termination, b) acceleration, c) completion
costs, d) justification for the termination, and e) damages. An
Expert Report was issued, and Expert Testimony was provided at
deposition and a jury trial.

Refinery
|
|
Working
for the Engineer, an analysis of the impact of active interference and
changes by the Owner in the Process design (P&IDs), procurement of
equipment, and design of electrical and I&C systems was
developed. Due to this Expert Report (as well as an active role
in the negotiating process) the A/E was successful in negotiating a
settlement.
